By using the Platform, you confirm that you have read, understood, and agreed to these terms. If you are entering into this Agreement on behalf of a company or another legal entity, you represent that you have the authority to bind such entity to these terms.

Description of Service

Qulify.AI provides an AI-driven platform enabling users to create and send personalised cold emails to prospects, integrated with user-generated content, for marketing purposes.

User Registration & Account Integrity

To access certain features of the Platform, you must register and create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

Subscription Options

Qulify.AI offers various subscription options, including monthly, quarterly, and annual plans. Details of these plans and associated fees are available on the Platform.

Purchase & Acknowledgment of Bundle

By purchasing from Qulify.AI, you acknowledge that you are buying a “Bundle” that includes the following individual products essential for AI-driven cold email marketing campaigns:

Each of these products incurs a real business cost to Qulify.AI, which is reflected in the bundle pricing. By using Qulify.AI, you agree to first contact our support team to resolve any issues before pursuing other remedies.

Infrastructure & User Responsibilities

Qulify.AI provides all the infrastructure needed to get started with AI-driven email outreach. However, users are responsible for acquiring and maintaining their own domains and mailboxes for sending emails.

If users do not wish to acquire domains and mailboxes independently or bring their existing ones, they can use the Done-For-You (DFY) process within the Qulify.AI platform. Through this service, users can purchase new domains and mailboxes, and Qulify.AI will handle all setup and configuration, allowing users to get started quickly without any technical burden.

Qulify.AI utilises third-party software and infrastructure to deliver aspects of the Platform. We are not responsible for any outages, errors, or performance issues caused by third-party providers.

Refund Policy

Qulify.AI upholds a strict No Refunds Policy. Subscription payments are final and non-refundable, covering partial subscription periods, unused services or user dissatisfaction.

This policy reflects the significant resources allocated to backend services such as cloud storage, data processing, and third-party integrations, which are essential for user account management.

User Conduct & Acceptable Use

You agree to use the Platform only for lawful purposes and in accordance with this Agreement. You will not use the Platform to create, distribute, or promote any unlawful content, infringing, defamatory, or otherwise objectionable material.

You are solely responsible for ensuring your use of the Platform complies with all applicable laws and regulations, including anti-spam, privacy, and data protection laws.

Content Ownership & Intellectual Property

All Platform content, including AI-generated content, is owned by Qulify.AI or its licensors. You may not use any content from the Platform except as permitted under this Agreement.

Limitations of Liability & Disclaimer of Warranties

Qulify.AI provides the Platform “as is” and without any warranty. We shall not be liable for any damages arising from your use of the Platform or AI-generated content.

In no event will Qulify.AI be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of, or inability to access or use, the Platform.

Indemnification

You agree to indemnify, defend, and hold harmless Qulify.AI and its affiliates, officers, agents, employees, and partners from any claim, suit, action, or demand, including reasonable legal fees, made by any third party due to or arising out of your use of the AI Communication Services, your violation of these terms, or the infringement by you, or made under your account, of any intellectual property or other right of any person or entity.

Privacy Policy & Data Usage

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into this Agreement by reference.

Termination & Account Cancellation

Qulify.AI reserves the right to terminate your account or access to the Platform for any breach of this Agreement.

Dispute Resolution & Governing Law

This Agreement shall be governed by the laws of New South Wales, Australia, without regard to its conflict of laws principles. Any disputes arising from this Agreement shall be resolved through final and binding arbitration.

Changes to the Terms of Service

Qulify.AI reserves the right to modify this Agreement at any time. Your continued use of the Platform after any such changes constitutes your acceptance of the new Terms.

Miscellaneous

This Agreement constitutes the entire agreement between you and Qulify.AI regarding the use of the Platform. If any provision of this Agreement is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the other provisions will remain in full force and effect.

User Acknowledgment

By using Qulify.AI, you acknowledge that you are purchasing a bundle of services with real business costs associated. You also understand that the success of marketing campaigns using our platform depends on various factors beyond our control, including market conditions and the quality of the input provided to our AI.

Your decision to use Qulify.AI’s services is based upon your own judgment and assessment of our platform’s capabilities. Your continued use of the Platform confirms your understanding and acceptance of the risk that the services may not meet all your expectations, and your agreement that Qulify.AI is not liable for such discrepancies.

Qulify.AI does not guarantee any specific performance metrics, including but not limited to response rates, meeting bookings, or revenue outcomes.
